Jigri’s Terms and Conditions

1. Services

STANVERSE TECHNOLOGIES PRIVATE LIMITED owns, operates and licenses the Jigri app and website that allows users to access content/infrastructure available on the Jigri app/website over the internet on internet-connected devices (“Services”). For the purpose of these Terms, ‘content/infrastructure’ shall mean and include the text, software, scripts, graphics, logos, photos, images, sound recordings, audio, podcast, radio programs, songs, music compositions, mp3, mp4, long form videos, short form videos, movies, reels, HD shows, audio-visuals, digital comics, e-books, audio books, courses, interactive features and other multimedia entertainment materials, metadata, and other materials accessed on or through the services.

The service is regularly updated and, therefore, we do not guarantee that particular content will be available on the Jigri app/website at any given point in time.

Our Service may contain commercial content, such as branded content or sponsorship messaging, promos for Jigri or information about other Jigri goods or services.

2. Account

Unless otherwise specified, the Services are available for individuals who have attained the age of majority, i.e., 18 years and above in the case of India. If you are below the relevant age of majority in your jurisdiction, you may access the Jigri services/app/website only under the supervision of a parent/guardian and in accordance with applicable law which enables a minor in Your jurisdiction to access such a service. However, in all cases, only persons of the age of majority are allowed to register an account on the services and will always be responsible for the operation of any such account.

A user may avail the services by creating a registered user account on the Jigri app/website to access certain features which may not be available without registration (“Account”).

You confirm that all data and information you provide to Jigri and its affiliates for the creation of the Account (“Registration Information”) is accurate, complete, and current, and you agree to keep it updated. You agree and undertake that the account created by you shall not be a fake profile, i.e., created by using false information or impersonating another person on our Services by using their name, photo, claiming to be someone other than yourself, or through any other means.

You are responsible for maintaining the confidentiality and proper use of your Account ID and password and for all activity through your account. You shall notify Jigri promptly of any breach of confidentiality or unauthorized use of your account.

If any loss is caused by any unauthorized use of your account, You may be liable for the losses suffered by Jigri or others due to such unauthorized use. Jigri shall not be liable for any losses caused by any unauthorised use of your account.

3. Free trial, Subscription & Payments

Subscription: You may subscribe to a plan of your choice out of the subscription plans offered by Jigri (“Subscription”). All of Jigri’s Subscription plans can be viewed on Jigri’s payment landing pages, which provide details on the plans, modes of payment and other subscription related details. After the creation of your account and the subscription, you will be able to access the services through the Jigri app/website. Your subscription will continue until terminated by you or by Jigri in accordance with these Terms.

We may change our subscription plans and the price of our Service from time to time. In order to get the latest information on subscription plans, please visit the Jigri app/website.

Some Subscription plans may have differing conditions and limitations, which will be disclosed at your sign-up or in other communications made available to you.

Payment: To use the service, you must provide us with one or more payment methods. Our subscription plans may include recurring payments (auto-pay mandate), providing you with continuous access to our services until cancelled. Unless you cancel your membership before your billing date, you authorize us to charge the subscription fee for the next billing cycle to your payment method (see Account Cancellation section below).

By purchasing a paid subscription, you authorize Jigri (or its payment partner/app store/website) to accept payment through a debit card, credit card, internet banking, unified payment interfaces or through e-prepaid wallet or other payment method (“Payment Method”) which are routed through our third-party payment service providers.

Purchase through Jigri currencies: [confirm if applicable] Jigri allows users to purchase currencies and use them to unlock various premium features of their choice on the Jigri app/website. Different types of currencies with varying values can be earned or paid. The Jigri app/website offers two types of currencies: currencies you paid to us (“Paid Currencies”) and currencies we give you for promotional purposes, without charge (“Promo Currencies”). Paid currencies and Promo currencies are collectively referred to as “Jigri Currencies”.

Free trial: Jigri may offer a free trial as per its discretion. To start the trial, a refundable verification/authorization charge may be processed to confirm payment details. This is not a fee and is reversed as per bank/card-network timelines.

Unless you cancel before the free trial ends, your Jigri subscription will convert automatically to a periodical plan and your payment method will be charged on the calendar day after the trial ends. If payment cannot be collected when due, we may suspend or downgrade your access until payment is successful.

4. Account Cancellation, Refunds & Renewals

Cancellation: You may cancel your subscription at any time, and you will continue to have access to the service through the end of your current subscription period. To cancel your subscription, please go to the respective payment partner and follow the instructions from them. For more details or assistance, you may contact our customer support team via the in-app/website live chat feature for quick help, or email us at contact@getstan.app.

If you are on a paid subscription, the cancellation will take effect the day after the last day of your current subscription period, after which you will be downgraded to the free version of the Jigri app/website. However, if you are on a free trial and choose to cancel your free trial before the expiry of the free trial period, your access to the service will end immediately upon cancellation, and you will not continue to have access for the remainder of the free trial period.

Refund: Users are eligible for a refund if they request it within 3 days from the date of purchase, including the first auto-renewal. Refunds will be processed to the original payment method within 5-7 working days. In order to raise queries or to seek clarifications regarding refunds, please reach out to our dedicated customer support team at contact@getstan.app. For instant communication, you may also raise queries through our chatbot available on the Jigri app/website.

Renewal: The subscription will be auto-renewed through your payment method upon expiry of your free trial via the auto-pay mandate, unless you cancel your auto-pay. You may choose to not renew your subscription. For this, you must cancel your subscription as per the process detailed above. Auto-pay mandates can only be cancelled by you through your payment method/banking channels, as creation/deletion of such mandates are individual and private banking transactions. To cancel auto-pay mandates, please reach out to your payment method facilitator. For any further guidance on auto-pay cancellation, please raise a query on the Jigri app/website chatbot.

5. Referral Program

The Jigri app/website may offer a referral program under which existing users (“Referrers”) can share a unique referral link or code provided in-app/website (“Referral”) with non-registered users. If a person who is not already registered (“Referred User”) accesses the Jigri app/website using that link or code, completes sign-up, and purchases a subscription on their Android application downloaded through the Google Play Store only, or website, the referrer will be eligible to receive cashback, subject to these Terms at the then-current referral program rules.

You will earn a cashback for each successful referral transaction. A referral is considered successful only when the referred user uses the referrer’s referral link or code to install the Jigri app/website and takes a subscription of the Android application/website. The referred user’s purchased subscription plan should not be less than the premium subscription offered on Jigri at the time of the referral.

Upon each successful referral, the referrer will earn a certain amount of Jigri currency for every referral as per the referral policy in the application/website. There is no overall limit to the amount a referrer can earn from this referral program.

A referred user may get a certain discount, or as may be specified on the subscription payment page as per the discretion of the company, on the purchase of their first premium subscription by using a referral link/code. Please note that this discount is only applicable to the first transaction made by a referred user on the Jigri Android application/website.

A referred user shall not be eligible to get a refund in the event the subscription is availed on a discount through the use of a referral link/code.

A referrer can redeem their earnings via the gift card redemption store. The referral link/code may be updated by the system every three months. You will earn rewards only from users referred during the active period of the Referral program. Any cashback-related queries should be raised within 15 (fifteen) days of the transaction.

Referrer is eligible for earnings only if the referred user has not previously transacted on the Jigri app/website. Both the referrer and referred user must use the latest version of the Jigri app/website to be eligible for earnings.

Referrer’s earnings will remain in a pending state for 3 days from the date of earning. You can withdraw your cashback within three months from the date of earning. If you fail to do so, the reward may be forfeited.

Jigri reserves the right, at its sole discretion, to modify or terminate any offers, promotions, or conditions without prior notice. Jigri may also deny cashback, revoke referral benefits, or suspend a user’s access to the Jigri app/website in cases of suspected fraud or misuse. For the purposes of this clause, fraud includes, but is not limited to, situations where the referrer and the referred user share or use the same device, payment method, credentials, or network parameters. Participation in the Referral Program is subject to acceptance of, and compliance with, all applicable Terms and Conditions of the Jigri app/website.

6. License & Permitted Use

Limited License: Jigri grants you a limited, non-exclusive, personal, non-commercial, non-transferable, non-sublicensable, revocable license to access and use the Jigri app/website and to view the content only during the subsistence of your account, solely within territories where Jigri makes such Jigri content lawfully available to you, and strictly in accordance with these Terms. No ownership or intellectual property right in any content is transferred to you. A parent/legal guardian may create and manage an account for a minor in accordance with these Terms and applicable law. Accounts and licenses are otherwise not transferable.

Jigri moderates the available content on the platform per the age group of the users. Users have been given access to report any unwanted/abusive content. The platform acts swiftly to take down any unwanted content to ensure a safe environment for its users. However, you should exercise your full discretion in accessing the platform and viewing the Jigri content.

The service and any content accessed through the service is for your personal and non-commercial use only and may not be shared with other individuals. You shall not use another’s account without permission.

Some features/content of the service may be geo-restricted. You may access the Jigri content only within the country in which you have established your account and only in geographic locations where we offer our service and have licensed such content.

You must not access or use the services, or any Jigri content, by any mechanism or method that conceals or falsifies your actual geographic location or otherwise circumvents our territorial controls. Prohibited methods include the use of virtual private networks (VPNs), proxies, anonymizers, Tor, DNS or IP-spoofing, GPS/location spoofing, emulators, or modified device/network settings that misrepresent your location. Service and content availability may vary by country/region due to licensing and legal requirements. We may detect and enforce territorial restrictions (including by reviewing IP address, network and device location settings, and similar signals) and may suspend or terminate access where circumvention is suspected or confirmed.

The quality of the display of the Jigri content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your internet connection. Jigri shall not be liable for any quality variations faced by you for any such factors outside the control of Jigri. You are responsible for all Internet access charges. Please check with your internet provider for information on possible internet data usage charges.

7. Service Availability & Maintenance

Jigri may temporarily suspend access to all or part of the Jigri app/website for maintenance, security, legal, operational, or business continuity reasons. Where practicable, Jigri will provide advance notice and will use reasonable efforts to restore access promptly.

Jigri may modify, remove, or discontinue any aspect, feature, or functionality of the Jigri app/website at any time (acting reasonably), and where practicable will provide notice.

Jigri shall not be liable for non-availability caused by events beyond its reasonable control (force majeure), including acts of God, war, riots, strikes, epidemics/pandemics, governmental orders, floods, fires, failures of public utilities, or satellite/network failures.

If you use the Jigri app/website, or any software component, you agree that it may automatically download and install updates (including bug fixes, enhanced functions, modules, or new versions) as part of your use.

8. Content & Intellectual Property

Jigri is the owner or valid and lawful licensee/assignee of all Jigri services made available on the Jigri app/website. Jigri owns in entirety all intellectual property associated with the Jigri services/app/website. No license or leave is granted by way of these Terms to you or anyone to exploit in any manner Jigri’s intellectual property except for the limited license given to you under these Terms.

You must not remove, alter, bypass, avoid, obscure, interfere with, or circumvent any copyright, trademark, patent, trade secret, or other proprietary notices, any digital rights management (DRM) or content protection or access control measures (including territorial/geo-filtering and age-gating), or any watermarks applied to the Jigri content.

Except as expressly permitted in these Terms or by Jigri in writing, you must not copy, download, capture, reproduce, duplicate, archive, distribute, upload, publish, modify, translate, broadcast, perform, display, sell, transmit, retransmit, frame, deep-link, make available, or otherwise exploit Jigri’s offerings or create derivative works from it.

You must not distribute any part of the Jigri app/website in any medium unless Jigri makes available the means for such distribution through functionality offered by the Jigri app/website.

Jigri does not permit copyright infringing activities or infringement of intellectual property rights on the services, and Jigri will remove all content if it is properly notified that such content infringes on another’s intellectual property rights in accordance with an appropriate court order. Jigri reserves the right to remove Jigri content, at its sole discretion, without prior notice.

9. User conduct & Restrictions

You agree to use the Service, including all features and functionalities associated therewith, in accordance with all applicable laws, rules and regulations, or other restrictions on use of the service or content therein. Except as explicitly authorized by us, you agree not to:

• Archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works from, offer for sale, or use content and information contained on or obtained from or through the service;
• Circumvent, remove, alter, deactivate, degrade, block, obscure or thwart any of the content protections or other elements of the service, including the graphical user interface, any advertising or advertising features, copyright notices, and trademarks;
• Use or launch any automated system (including robots, spiders, offline readers, or scripts) that accesses the Jigri app/website in a manner that sends more request messages to Jigri’s servers in a given period than a human can reasonably produce using a conventional online web browser. Public search engines may crawl publicly accessible pages solely to create searchable indices (not caches or archives), subject to Jigri’s right to revoke this permission at any time;
• Decompile, reverse engineer or disassemble any software or other products or processes accessible through the service;
• Insert any code or product or manipulate the content of the service in any way;
• Use any data mining, data gathering or extraction method;
• Upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the service, including any software viruses or any other computer code, files or programs;
• Engage in any of the foregoing in connection with the use, creation, development, modification, prompting, fine-tuning, training, testing, benchmarking or validation of any machine learning tool, model, system, algorithm, product or other technology;
• Violate any intellectual property (copyright, trademark, patent, trade secret), privacy, or publicity rights;
• Cover, remove, disable, manipulate, block, or obscure advertising or other portions of the services or the content;
• Delete or revise information provided by or pertaining to any other user;
• Engage in commercial activity (including advertisements or solicitations of business; sales; contests; sweepstakes; creating, recreating, distributing, or advertising an index of any significant portion of the content; or building a business using the content/feature set) without Jigri’s prior written consent;
• Use technology or other means to access, index, frame, or link to the Jigri app/website (including the Content) in a manner not authorized by Jigri;
• Use the Jigri app/website to advertise or promote competing services;
• Use the Jigri app/website in a manner inconsistent with any and all applicable laws;
• Attempt, facilitate, induce, aid and abet, or encourage others to do any of the foregoing;
• Circumvent, disable, or otherwise interfere with security-related features of the service or features that prevent or restrict use or copying of any content or enforce limitations on use of the services or the content therein.

We may terminate or restrict your use of our service if you violate these Terms or are engaged in illegal or fraudulent use of the service. Jigri reserves the right to decide whether your conduct violates these Terms.

10. Third Party Services

The Services may contain links or integrations to third-party websites, applications, services, content, features, payment processors, app stores, or social media plug-ins (collectively, “Third-Party Services”). Jigri does not control, endorse, monitor, or make any representations or warranties about any Third-Party Services, and is not responsible for their availability, accuracy, legality, security, practices, or policies (including privacy, cookies, data collection, or marketing). Links are provided solely for convenience and do not imply endorsement or verification.

Your access to or use of any third-party services (including any purchases, transactions, downloads, or account connections) is solely between you and the applicable third party and is subject to that third party’s terms, conditions, and privacy policies. It is advised that you should review those terms and policies carefully before using any third-party services.

To the maximum extent permitted by applicable law, you agree that Jigri shall not be liable for any loss, damage, harm, malware, data breach, tracking, or other consequences arising from or related to Your use of any third-party services. Jigri may remove or disable access to any link or integration at any time without notice.

11. Disclaimer of Warranties

You understand and agree that the services are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by applicable law, Jigri and its affiliates, officers, directors, employees, and agents (collectively, “Jigri Entities”) disclaim all warranties, conditions, and representations, whether express, implied, statutory or otherwise, including merchantability, fitness for a particular purpose, title, accuracy, completeness, and non-infringement, and any warranties arising from course of dealing or usage, and assume no responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from Your access to and use of our services; (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein; (iv) any interruption or cessation of transmission to or from our services; (v) any bugs, viruses, trojan horses, or the like which may be transmitted to or through our services by any third party; and/or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the services. Jigri does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party.

Without limiting the foregoing, Jigri does not warrant that the Services will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components; that defects will be corrected; or that content will be accurate or complete.

The services may contain links to third-party websites/services. Jigri does not control or endorse, and is not responsible for, any third-party content, products, services, advertisements, or policies. Your dealings with third parties are solely between you and those third parties.

12. Limitation of Liability

To the maximum extent permitted by law, the Jigri Entities shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or for loss of profits, revenues, goodwill, data, or use, arising out of or related to the services or these Terms, whether based in warranty, contract, tort (including negligence), statute, or any other legal theory, whether or not Jigri is advised of the possibility of such damages.

You specifically acknowledge that Jigri shall not be liable for the content or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

The total aggregate liability of the Jigri Entities for all claims arising out of or relating to the services or these Terms shall not exceed the greater of: (a) INR 499 (Indian Rupees Four Hundred and Ninety-Nine); or (b) the total fees you paid to Jigri for the services in the six (6) months immediately preceding the event giving rise to the claim.

The service is controlled and offered by Jigri from its facilities in India, for India. Jigri makes no representation that the service is appropriate or available for use in other locations.

Users who access or use the services from other jurisdictions do so at their own volition and are responsible for compliance with local law.

13. Indemnity

You agree to defend, indemnify, and hold harmless the Jigri Entities from and against any and all claims, demands, actions, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your breach of these Terms;
• Your violation of any applicable law or of any third-party right (including intellectual-property, privacy, or publicity rights) while availing or using the Services;
• misuse of the Services; or
• any activity on your Account that violates these Terms.

Jigri may assume the exclusive defense and control of any matter subject to indemnification; you will cooperate as reasonably requested. You shall not settle any claim without Jigri’s prior written consent (emails permitted), and Jigri may settle any claim without Your consent if the settlement does not impose any admission of liability or monetary obligation on you beyond this indemnity.

14. Copyright Infringement, DMCA and Piracy

Copyright Infringement: If you believe that your copyright-protected work was posted on the Jigri app or website, or otherwise hosted by Jigri, without authorization, you may submit a copyright infringement notification to our grievance officer. The notification must include the following:

• An email address, physical address, or phone number so that we can contact You.
• A clear and complete description of Your work that You believe has been infringed.
• The URL or other identifying location of the allegedly infringing work.
• A statement that You have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
• A statement, made under penalty of perjury, that the above information is accurate and that You are the copyright owner or are authorized to act on behalf of the owner, along with details establishing that You or the person on whose behalf the notification is being made is the bona fide owner of the copyright in the work that has been allegedly infringed.
• Undertaking that You or the person on whose behalf the notification is being made shall file an infringement suit in the competent court against the person responsible for uploading the infringing copy and produce the orders of the competent court having jurisdiction within a period of twenty-one days from the receipt of this notification.
• The physical or electronic signature of the copyright owner or an authorized representative of the copyright owner. To satisfy this requirement, you may type your full legal name (not that of a company) at the bottom of your notification.

Submit the above information to our grievance officer:

All information submitted in Your copyright infringement notification may be made public in any way by Jigri or a third party.

Piracy: If we are made aware, either by a third party or through our detection system, of any specific instances wherein Jigri content published on the Jigri app/website is copied and made available on any external medium by any person, then:

• Our detection mechanism will, to the extent practically possible, monitor such infringement and will have the Jigri content removed from the external medium as per the process enabled by such external medium.
• When we are made aware that Jigri content published on the platform is being downloaded and saved onto files and/or you or a third party is stream ripping the Jigri content and publishing it on any external platform, then we shall report the same and shall ask for the external platform/website to be removed. We may at our discretion take legal action against you or any such third party.
• If the external platform fails to take action and/or fails to remove such infringing content from the external platform, then we may, at our discretion and not being obligated to, initiate legal proceedings against the external platform.

15. Grievance Redressal

In the event you face any other content-related issue, you may contact our Grievance Officer using the details below:

Our process and timelines:

• Acknowledgement: We will acknowledge receipt of your grievance within 48 hours of receipt.
• Tracking: We will issue a unique ticket/reference number so you can track your complaint.
• Disposal/Resolution: We will dispose of/resolve your grievance within 15 days of receipt, or sooner where required by law.

We may contact you for additional information; we request you to respond promptly, as failure to provide requested details may delay resolution.

16. Governing Law

These Terms are governed by the laws of India. Subject to applicable law, the courts at Bangalore, Karnataka shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms.

17. Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without Jigri’s prior written consent. Jigri may assign these Terms (in whole or in part), including in connection with a merger, acquisition, corporate reorganization, or sale of assets, with notice to you where required by law.

18. Miscellaneous

Entire Agreement: These Terms, Privacy Policy, and Content Grievance Redressal Mechanism together with any other policies expressly incorporated by reference, constitute the entire agreement between You and Jigri regarding the Services and the Jigri app/website.

Severability: If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary (or severed), and the remaining provisions will remain in full force and effect.

No Waiver: Failure to enforce any provision by Jigri is not a waiver of such provision or any other provision.

Survival: Provisions that by their nature should survive (including disclaimers, limitations of liability, indemnity, governing law/jurisdiction, assignment, and payment obligations) will survive termination or expiry of these Terms.

Notifications: You hereby consent, agree and authorise Jigri to send notifications on SMS/RCS/Messages/Promotional/Informational Messages.

Change in Policy: Jigri reserves the right, at any time and from time to time, with or without prior notice (we will provide periodic notice of material changes), to update, revise, supplement, and otherwise modify these Terms and to impose new or additional rules, policies, terms, or conditions on Your use of the Services (collectively, “Revised Terms”). The Revised Terms will be posted on the Jigri app/website and will be effective immediately upon posting unless a later effective date is stated. We recommend that you periodically check that page for the Revised Terms. Your continued use of the services after such posting constitutes your acceptance of all Revised Terms. Nothing in these Terms shall be deemed to confer any third-party rights or benefits.
